America in a Constituional crisis

Some time ago I blogged something I had been coming to grips with. Within the confines of that blog i had enumerated the aspects of Contract Law that the Constitution appeared to converge with. That revelation alone was a sweeping one let alone the ramifications of such an outlook. In this Blog it will be my intent to piece together this puzzle and show how America is in the throws of a Constitutional crisis that unless corrected will have irrevocable consequences on our future.


AMERICA IN A CONSTITUTIONAL CRISIS

The men who created the Constitution left us with a document of unparallelled construction. There is no question that the intent of the founders was to create a document that defied corruption. The checks and balances within the document were for that purpose and that purpose alone. We will examine both popular and secularized views on the intent these men expressed through the document. The beginning of the Declaration of Independence states quite eloquently the partial intent of the founders, "When in the Course of human events, it becomes necessary for one people to dissolve the political bands which have connected them with another, and to assume among the powers of the earth, the separate and equal station to which the Laws of Nature and of Nature's God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation. We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights,[75] that among these are Life, Liberty and the pursuit of Happiness. That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness. Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes; and accordingly all experience hath shewn, that mankind are more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed. But when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security.

We must understand something here. In order to fully understand the meaning you must also understand the mindset. These men were expressing the "Political Will" of the people as they were made to understand it. This idea alone should inspire one to quandry, "How did they know this was the political will of the people"? The inquisitive mind always asks the hard questions in order that his/her understanding of the issue is not clouded and or partial to one sect or another. And so the critical thinker asks not only the "HOW" but the "When, Why, Who, What, and Where". In this way we can follow the trail to it's obvious conclusion.

So then the "Political Will" of the people had to have been expressed somehow. It's an unknown but widely accepted rule that the Political will of the People is expressed in culture. This comes down to Artistic expression, Writing, and the General achievements of a sect, or gathering of people. In this way as well as through taking polls Political will is established. Once Political will is established Political leaders can then find ways of expressing said will to the liking of the people whether its creation of laws for their protection and security or by other means. I would now like to begin by looking at a different sect that is inherent in all cultures and assemblies of people. There is and has always been a type of person in this world driven to success beyond the normal expression of political will of the many. This type of person is well documented in history and their exploits have literally raised or Razed entire Nations and cultures. This type of person is only concerned with self and if by chance they are in support of another it's solely for personal gain. This type of person functions much like a parasite. It invades a host and once it uses or takes all the resources it then spreads to another host to repeat the process. It is by this type of persons exploits that some of our most beloved sayings derive: "History is written by the victors" (Winston Churchill), "To the victor go the spoils" (1832 By Senator William Learned Marcy), "Fortune favors the bold" (Virgil in the Aeneid), “If once the people become inattentive to the public affairs, you and I, and Congress and Assemblies, Judges and Governors, shall all become wolves. It seems to be the law of our general nature, in spite of individual exceptions.” Thomas Jefferson.

The quotes go on literally forever, as well as an inclusion in the Declaration Of Independence, the point however is that people like this exist and always have. They see themselves not as the part of a whole but as the pinnacle of human development to be revered and at times worshiped. So then a group of men having perhaps some of these traits but lacking in the desire to pursue them, created a document that they believed would deter such men as this from doing to their beloved homeland as had been done everywhere else, a gradual but steady usurpation. This they enumerated in the Declaration Of Independence. And so another question then is what "New Guards" were our forefathers referring to in terms of protection of future security? As was mentioned earlier, perhaps some of the founders possessed such traits that one would consider (here we use the term "Elitist" for lack of a better descriptive) elitist. Certainly they were influential. They were well educated. Many of them had ties to elitists and powerful families in Brittan. They had money. And yet these men had also one other thing in common, a deep seeded Religious zeal rooted in Christianity. This spiritual connection they shared had a powerful "Quantum" effect in that they were without knowing it setting up both a physical and spiritual Government.
